Community Property in New Mexico & Why It Makes Postnuptial Agreements Worth Considering

New Mexico is one of nine community property states. The default rule is straightforward: property acquired during the marriage is presumed to be owned equally by both spouses and divided 50/50 in a divorce. That default applies regardless of whose name is on the title, which spouse earned the income, or how long the marriage lasted.

A valid postnuptial agreement can override those defaults and allow both spouses to define their own property division terms. Specific assets can be designated as separate property.
